Legal Victory by the Fundació Salvador Dalí in the Defense of the Artist's Resale Rights

PARIS.- The Fundació Gala-Salvador Dalí announced that the High Court of Paris has upheld the claims of the Fundació Dalí and acknowledges that the Spanish State is the sole holder of the resale right on the works of Salvador Dalí. The Foundation is glad to receive such a transcendental ruling because it is not only a step forward in the defence and protection of Salvador Dalí's rights but it also creates jurisprudence.

In a ruling passed on Friday 8 July, the High Court of Paris, upholding in its entirety the claim submitted by the Fundació Dalí and VEGAP against the ADAGP (the French collective management agency of visual artists' royalties, which corresponds to the Spanish VEGAP), declared that Spanish law is the applicable law for determining which party is the holder of the resale right on the artworks of Salvador Dalí, and consequently acknowledged that the FUNDACIÓ DALÍ, as the manager and administrator of the royalties on Salvador Dalí's works by delegation of the Spanish State (the artist's testamentary heir), is the beneficiary of the resale right accruing from resales of Salvador Dalí's works.

In 2006, the FUNDACIÓ DALÍ initiated legal proceedings in Paris against the ADAGP claiming the resale right obtained in public auctions of works by Salvador Dalí. The resale right is the right of authors and their heirs to receive from the seller a part of the price of any resale of the authors' works in public auction, in a mercantile establishment, or with the intervention of a dealer or mercantile agent.

In its claim, the FUNDACIÓ DALÍ argued that the resale right forms part of the assets comprising Salvador Dalí's estate, and that the determination of the beneficiary of that right is a question of inheritance law, the applicable legislation being that governing the artist's estate, that is to say, Spanish law, which admits the transfer mortis causa of the resale right to any natural or legal person; consequently, his heir, the Spanish State, is the sole holder of this right and the sole party entitled to receive it, through the FUNDACIÓ DALÍ as the party exclusively responsible for its management and administration.

The artist's relatives were called to the proceedings by the ADAGP but decided not to appear. However, they have to right to appeal against the ruling now passed.

Before passing judgment, the High Court of Paris addressed the Court of Justice of the European Communities to raise two prejudicial questions, the more important of the two concerning the possibility that, following Directive 2001/84/EC, France could maintain a resale right reserved solely to the legal heirs with exclusion of the testamentary heirs.

On 15 April 2010 the Court of Justice of the European Communities replied to this question in the affirmative, stating that the Directive did not oppose a provision of internal French law reserving the benefit of the resale right to the legal heirs, excluding the testamentary legatees. However, the CJEC made an implicit acknowledgement that the internal French regulations on beneficiaries of the resale right was not applicable to the inheritances of foreign artists, which were regulated by the inheritance law of their own country, as recognised in the applicable international rule regulating the matter, Article 14.ter of the Berne Convention for the Protection of Literary and Artistic Works.

The ruling of the High Court of Paris adopts precisely this argument and declares that the resale right already exists at the moment of opening of the succession, and consequently it is the national law applicable to succession which must determine the holders of that right.

Thus, the High Court has declared that, on the basis of the provisions of Article 14.ter of the Berne Convention, the sole holder of the resale right on Salvador Dalí's works is the Spanish State, and orders the ADAGP to pay the said right to the FUNDACIÓ DALÍ as the assignee thereof.

The ruling specifically orders the ADAGP:

- To communicate to the FUNDACIÓ DALÍ and VEGAP the entirety of the information and supporting documents on the amounts received and, as the case may be, paid under the heading of resale right since 17 October 1997 (the date on which the FUNDACIÓ DALÍ joined VEGAP and the ADAGP);

- To pay to VEGAP, on account of the FUNDACIÓ DALÍ, any amounts it may have received under the heading of resale right since 17 October 1997, plus the corresponding interest since the filing of the claim;

- To pay the fees of the lawyers of the FUNDACIÓ DALÍ and VEGAP and to compensate them with the joint amount of 10,000.-euros.

Without prejudice to any appeal which may be lodged, the Court has ordered the provisional enforcement of the ruling.

The importance of this decision is twofold:

(i) On one hand, it acknowledges in favour of the Spanish State the holdership of the resale right on the works of Salvador Dalí, which right generates revenues which the ADAGP has been paying to relatives of Salvador Dalí who were not mentioned in his will, in which he instituted as his universal heir the Spanish State;

(ii) On the other hand, it acknowledges the application in France of Spanish law to the succession of a Spanish artist. This aspect goes beyond the specific case posed by the FUNDACIÓ DALÍ, since a contrary declaration by the High Court of Paris would have signified acknowledging that a country's internal legislation may modify not only the inheritance law of another country but also the testamentary will of any person.

In the proceedings before the High Court of Paris, the FUNDACIÓ DALÍ has been represented by the lawyers designated by the Roca Junyent firm, the institution's legal advisors.

World Monuments Fund To Bring Chancellerie d'Orleans Interiors Back on View

PARIS.- World Monuments Fund (WMF) Europe announced today a project to restore and reconstruct the interiors of the Chancellerie d'Orleans, which have been in storage for nearly ninety years. One of the most important Parisian hôtel particuliers of the eighteenth century, the Chancellerie d'Orleans was demolished in the 1920s but its interiors were saved and stored for later reinstatement elsewhere. Now that a preliminary study by a French Architecte en chef des Monuments historiques has been completed, the interiors will be installed in the former Hôtel de Rohan-Strasbourg, a structure contemporary to the Chancellerie and now the Archives nationales.

NEW YORK, NY.- On Wednesday, August 3, Swann Galleries will conduct a two-session auction of Vintage Posters, which features a wonderful assortment of summer resort and beach posters from around the world, World War I and II propaganda posters, and the ever-popular Mather Work Incentive posters. The sale opens with a selection of more than 40 American turn-of-the-century literary posters—which is the largest offering of these works at auction in years. The majority are Edward Penfield's designs for issues of Harper's magazine. Penfield, known as the "Father of the American Poster," depicted an elegant couple in a rowboat for the June 1894 issue; a Yalie at a Harvard vs. Yale football game in November 1894; and a raven-haired beauty cuddling two cats for Harper's May, 1896 (estimates: $1,500 to $2,000 each).

Lancaster, PA.- The Demuth Museum is pleased to present "Demuth in the City of Lights", on view at the museum until August 28th. This exhibition brings together many of Charles Demuth's works from his time in Paris in the early twentieth century. Demuth (1883-1935) soaked up all Paris had to offer by visiting galleries, attending live performances, discussing ideas with fellow artists including Marsden Hartley and Marcel Duchamp, and drinking up the night-life. Upon returning home to Lancaster, he poured out his art work. Like other foreigners in Paris, Demuth did seek out art instruction and this exhibit will feature examples of Demuth's figure drawings of live models from his classes at the Academie Colarossi and the Academie Julien. This exhibition will also highlight Demuth's pictures of the people and places he saw during his time in France, including portraits of such notables as Igor Stravinsky and Alice B. Toklas, landscapes such as a lively beach scene from the French coastal town of Étretat; and some vibrant watercolors from the many stage performances Demuth attended while in Paris. The exhibit features works by Demuth drawn from the Demuth Museum's permanent collection as well as a dozen rarely exhibited pictures from private collections.

National Museum of Art in Wales Opens Six New Contemporary Art Galleries

Wales has many fascinating stories to tell through the work of the artists and collectors from, or inspired by, Wales. A number of these stories are told in the new £6.5m National Museum of Art ( Amgueddfa Cymru ), which opened to the public on Saturday 9th of July. For the first time, the full range of the nation's world-class art collection – a mix of fine and applied art, from the historic to the contemporary - is displayed under one roof at National Museum Cardiff, giving a new visibility to art in Wales and the art of Wales. The National Museum of Art features six impressive new contemporary art galleries, which offer 40% more space to display art from post-1950. More than 34,500 of the 9/11 Memorial Tickets Reserved

NEW YORK CITY - More than 34,500 visitor passes to the new Sept. 11 Memorial are gone — distributed Monday in just the first hours after the ticket website went live. The online reservation system for the tickets was up at 9 a.m., and 5,000 were secured for various dates in just the first hour of operation. The quick response is "what we were hoping for — that people would be interested in the site the public has not set foot in for 10 years," Joe Daniels, president and CEO of the National September 11 Memorial & Museum, told The Associated Press. The memorial plaza opens to the public on Sept. 12, a day after the 10th anniversary. The 9/11 Memorial features two enormous waterfalls and reflecting pools, each about an acre in size, set within the footprints of the original twin towers.

Sotheby's to Offer 400 Items from The Fabius Frères Gallery Collection

PARIS.- Sotheby's announce, in association with the auction house PIASA, the sale of the Fabius Frères Gallery collection on the 26th and 27th October 2011 in Paris. The 400 sculptures, pieces of furniture, works of art, drawings and 19th century paintings, estimated to sell in the region of €10 million ($14,5 million), will be on view at the Galerie Charpentier for five days prior to the sale. The Fabius Frères Gallery is known worldwide for the exceptional quality, condition and provenance of the works of art in their collection. The Fabius Frères collection is undoubtedly the most important ensemble of 19th century sculpture ever to be offered at auction. It consists predominantly of works by the most original and significant sculptors of the period: Antoine–Louis Barye (1795–1875) and Jean–Baptiste Carpeaux (1827–75).


The Brandywine River Museum Shows Jamie Wyeth's "Farm Work"

Chadds Ford, PA.- The Brandywine River Museum is proud to present "Farm Work by Jamie Wyeth", an extensive exhibition that surveys five decades of his lively depictions of farm animals, equipment, buildings and landscape. Wyeth's depictions of farm work and life combine his artistry, wit and sense of wonder. "I always said that if born in New York, I would be painting cabs or something, but it happens that I was raised in an area where there were farms. There are wonderful objects on the farm and things about farm life, so that is where the attraction is," says Jamie Wyeth. "Farm Work by Jamie Wyeth" is on view at the museum until September 11th.


Point Lookout, the farm on the Brandywine that Wyeth moved to in the late 1960s after his marriage to Phyllis Mills, has been the primary location for many of his paintings, but other farms have had a strong impact as well.  His earliest farm works were painted as a teenager on trips to the Olson farm in Maine that was made famous by his father, Andrew.  In Chadds Ford during the same years, he made countless visits to a nearby farm where he met Den-Den, the pig who became the subject of his life-size "Portrait of Pig". Wyeth painted the portrait at Point Lookout where he took the pig to live in order to save her from the butcher.  Den-Den was joined by a coterie of animals that grew over the years to include chickens, geese, goats, cattle, horses, and wild birds. All have been subjects of paintings by Wyeth, who says, "Animals just intrigue the hell out of me, really much more than people."

On view at the Brandywine River Museum, PA Other aspects of the farm have also held a strong attraction for the artist.  Barns, plows, saws, buckets, and bales of hay intrigue him as ordinary objects and strong shapes.  The farm is a magical association with objects that are reflected in his interpretations.  He describes the painting "Tin Woodsman" as being informed by The Wizard of Oz, saying, "Through this whole farm obsession of mine, I sort of viewed myself as a latter day Dorothy — my life is filled with real and imagined characters." Farm Work by Jamie Wyeth is the first exhibition to focus exclusively on this subject.  It includes over 70 works drawn from private and public collections across the country.  The accompanying catalogue is fully illustrated in color and contains extensive commentary by the artist.

In the mid-1960s, Chadds Ford, Pennsylvania in the historic Brandywine Valley, faced possible massive industrial development. The impact would have dramatically changed the character and future of a community that was then largely rural.  At the same time, and for decades thereafter, development proposed throughout the region, particularly in floodplain areas, threatened to devastate water supplies for numerous communities in southeastern Pennsylvania and northern Delaware, including the City of Wilmington. Appreciating the need for rapid action, a group of local residents bought endangered land and founded the Brandywine Conservancy in 1967. The first conservation easements, protecting more than five and one-half miles along the Brandywine, were granted in 1969.  Today, the Conservancy holds more than 430 conservation easements and has protected more than 44,000 acres in Chester and Delaware counties, Pennsylvania, and in New Castle County, Delaware. In 1971, the Conservancy opened the Brandywine River Museum in the renovated Hoffman's Mill, a former gristmill built in 1864 that was part of the Conservancy's first preservation efforts.

With nearly six million visitors to date, the museum has established an international reputation for its unparalleled collection and its dedication to American art with primary emphasis on the art of the Brandywine region, American illustration, still life and landscape painting, and the work of the Wyeth family. Among the hundreds of artists represented are Howard Pyle, many students of Pyle who affected the course of American illustration, N. C. Wyeth, Andrew Wyeth, and Jamie Wyeth.  There is work by hundreds of famous illustrators.  Landscape, still life, portrait and genre painting includes work by Benjamin West, Gilbert Stuart, Asher Durand, W. T. Richards, William Harnett, John Haberle, J. D. The Picturesque Zorn Museum in Mora, Sweden

Anders Zorn, a famous Swedish artist and art collector, gathered over the years in which art and crafts in large quantities. He also had plans to build a museum for his collections. There was, however, his widow, Emma Zorn, who along with Zorn Collections senior curator, Professor Gerda Boëthius, came to realize his plans. Zorn Museum was opened in 1939 in Mora, Sweden. The Zorn Museum was designed by Ragnar Ostberg, known as the architect to City Hall. Zorn Museum was Östberg's last work. The classicism brick building was supplemented in 1982 with a glazed stairwell on the west side, designed by architect Torbjörn Olsson. In 1996 the museum was equipped also with an extension of exhibition galleries, library and museum office. Anders Zorn had educational ambitions of the museum he planned. This would allow art lovers and students to have the opportunity to see and learn from arts and crafts from around the world. That ambition remains to some extent still today, even though the focus over the years increasingly been directed at the artist's own works. The permanent exhibition offers paintings by Midnight (1891), Vall Kulla (1908), Dancing in Gopsmorstugan (1913) and the two self-portraits in red and the wolf-skin coat (both 1915). Among the watercolors are Grandma (1883), Misses Solomon (1888) and a large number of water studies. Zorn's etchings occupy a single room. The Zorn Museum also displays works of contemporary friends of the artist Bruno Liljefors, Carl Larsson, Prince Eugene, Albert Edelfelt and others. Zorn Museum and Zorngården is centrally located in Mora.. Zorn Gammelgård and Textile Chamber is exactly one kilometer from the Zorn Museum (a beautiful walk along the shore of Lake Siljan). Gopsmor is situated two miles north of Mora. Anders Zorn (1860 – 1920) painter of three US presidents is internationally renowned for his portraits and paintings. At the World Exhibition in Paris in 1889 Zorn was awarded the French Legion of Honour, all Swedish newspapers featured this art news about their celebrated artist.

MADRID.- The Museo del Prado has broken a ten year old attendance record with its Sorolla exhibition. More than 450,000 persons visited the exhibition which closed last Sunday. The director of the Museo del Prado, Miguel Zugaza, made the informaion public today saying that this exhibition was visited by more persons than others held in previous years. Incuding Velázquez, Ribera, Murillo, El Greco, Zurbarán and Goya museum exhibitions.

"Irving Penn Portraits" Opens At The National Portrait Gallery

LONDON - Irving Penn (1917–2009) was one of the great photographers of our time. Focusing specifically on his portraits of major cultural figures of the last seven decades, Irving Penn Portraits is a glorious celebration of his work in this genre. The exhibition is brought together from major international collections and includes over 120 silver and platinum prints, many vintage, ranging from his portraits for Vogue magazine in the 1940s to some of his last work. On view at the National Portrait Gallery through 6 June, 2010.

Tamara de Lempicka's Art Deco Paintings on View for the First Time in Mexico City

MEXICO CITY.- President Felipe Calderón inaugurated the Tamara de Lempicka Exhibition at the Palace of Fine Arts, adding that during his government, an enormous effort has been made to enable Mexicans to discover and enjoy great national and international exhibitions, some of which have been unparalleled. He said that Tamara de Lempicka belongs to the great 20th Century women painters who were attracted to Mexico and found refuge and a source of inspiration here, such as Remedios Varo, Leonora Carrington and Alice Rahon. Of Tamara de Lempicka, the President said that her fascinating, avant-garde plastic discourse made her one of the main exponents of Art Déco. The exhibition gathers 48 paintings, 15 works on paper and 21 photographs, that come from private collections in France, Belgium, Germany, Spain, United States and Mexico. It is important to mention that Jack Nicholson's collection has been included in the show.

The Queen’s Gallery to exhibit "Realism Found"

Charlotte, NC – Katherine Blackwell, Cher Cosper, David Thayer French, Joshua Gage, Paul Keysar, Andrew Leventis, Osiris Rain, and P. S. Thibodeaux will display their work June 1 through 30, 2009, in an exhibit titled "Realism Found: Charlotte Artists Find New Meaning in an Old Tradition", at The Queen's Gallery, 1212 The Plaza, Charlotte, NC 28205. The opening reception is Friday, June 5, 2009, from 6:00 to 9:00 p.m. Artists will be in attendance.
